Terms of Service

1. Acceptance of Terms

By purchasing coins and using the Cerast Intelligence service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

The Service provides pay-per-search access to security intelligence data through a coin-based payment system. You purchase coins that grant you the ability to execute searches and access categorized security findings. The Service does not guarantee uptime, search result availability, or the volume of data returned.

3. Nature of Coins and Virtual Currency

No Monetary Value

Coins purchased on our platform are virtual credits that grant access to our services. They hold no monetary value and cannot be exchanged for cash, transferred to other users, or redeemed outside of our platform.

License to Use Services

By purchasing coins, you are granted a revocable, non-transferable license to use our search services. You do not acquire any ownership rights to the coins themselves, the search results, or any data provided through our platform.

Coin Validity

While purchased coins do not expire under normal operations, they are subject to the Service Discontinuation terms outlined below. Coins represent access rights to services, not property or assets with inherent value.

4. Service Discontinuation and Termination

Business Termination

In the event that Cerast Intelligence discontinues operations or terminates the service, all unused coins will lose their value immediately and no refunds will be issued. Search results previously accessed may become unavailable.

No Guaranteed Access

We do not guarantee perpetual access to the service or to previously purchased search results. While we strive to maintain service availability, circumstances beyond our control may require service modification or termination.

Account Termination

Any violation of these Terms will result in immediate termination of your account without any refund for unused coins. We may terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately.

Important Notice: Coins and access to services are provided "as-is" without warranty. Users hold no property rights or claims to coins, virtual credits, or data accessed through the platform.

5. Use of Data

Permitted Use

Research and Analysis: You may use the data provided through the Service for conducting security research, vulnerability assessment, and analysis purposes.
Internal Use: Data may be used internally within your organization for security improvement and risk assessment.
Derivative Works: You may create reports and analyses based on the data for legitimate security purposes.

Prohibited Use

Distribution Prohibited: You are expressly prohibited from publishing, reselling, or distributing the raw data received through the Service in any form.
Legal Compliance: The data may not be used for any illegal activities or to support any illegal activities.
Malicious Use: Data may not be used to facilitate attacks, exploits, or other malicious activities against systems or individuals.

6. User Responsibilities

You must keep your access credentials confidential and not share them with any third party. You are responsible for all activities that occur under your account and agree to immediately notify us of any unauthorized use of your account or any other breach of security.

7. Prohibited Conduct

In addition to the prohibited uses of data outlined above, you agree not to:

Attempt to circumvent, disable, or interfere with security features of the Service
Use automated systems or bots to access the Service without authorization
Attempt to gain unauthorized access to other users' accounts or data
Reverse engineer, decompile, or disassemble any portion of the Service
Engage in any conduct that restricts or inhibits anyone's use of the Service

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to:

The implied warranties of merchantability and fitness for a particular purpose
Non-infringement of third-party rights
Accuracy, completeness, or reliability of search results
Uninterrupted or error-free operation of the Service
Security of data transmission or storage

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Cerast Intelligence be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:

Loss of profits, revenue, or data
Cost of substitute services
Business interruption
Personal injury or property damage
Loss of goodwill or reputation

This limitation applies regardless of the cause of action, whether in contract, tort, negligence, or otherwise, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Cerast Intelligence, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

Your access to or use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any misuse of data obtained through the Service

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through a notice on the Service. Continued use of the Service after such changes constitutes your acceptance of the modified Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Fulda, Germany.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

14. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Cerast Intelligence regarding the use of the Service and supersede all prior agreements and understandings.
